Inheritance · Madrid region
Full inheritance
and sale, without the headaches.
Inheriting a home in Madrid, especially from abroad, can feel overwhelming: paperwork, notaries, deadlines, taxes. We have more than 35 years of experience in the sector and lawyers specialised in inheritances who handle it from start to finish. Then we sell the property for 2.5% + VAT, all included. One team, from the notary to the sale.
How it works
- We give you a fixed quoteYou tell us about the case (who has died, whether there is a will, how many heirs there are) and we give you a fixed price for the inheritance.
- We handle the whole inheritanceThe will or the declaration of heirs, acceptance and division before a notary, calculation of the applicable taxes and registration in the Land Registry. Even if one of you lives abroad.
- We sell the propertyOnce it’s in your names, we sell it for 2.5% + VAT, all included: photos, buyers, viewings, lawyers and notary. And the money goes to each heir.

We prepare the deed of acceptance and allocation, even if one of the heirs lives abroad.
Taxes
Calculation of the applicable taxes, filed on time.
Registry and sale
Registration in the Registro de la Propiedad (Land Registry) and then the sale for 2.5% + VAT, all included.
Heirs living outside Spain
What you should know if you, or the person who has died, lived abroad:
Madrid’s reductions apply to you too
Children, spouses and parents get a 99% reduction of inheritance tax in Madrid; siblings, nephews, nieces, uncles and aunts, 50% (deaths from 1 July 2025). Non-resident heirs can apply these regional rules.
Six-month deadline
Inheritance tax must be filed within 6 months of the death. You can ask for 6 more months if you apply in time.
Which law applies
Under the EU Succession Regulation, the law of the country where the deceased habitually lived usually governs the inheritance, unless they chose the law of their nationality in their will.
Your own country’s taxes
Your country may also tax the inheritance. Spanish tax paid can often be credited there; we coordinate with your adviser.

Frequently asked questions
How much does handling the inheritance cost?
It depends on the case: whether there is a will, how many heirs you are, how many assets there are and where they are. That’s why we give you a fixed quote before starting, separate from the sale. Taxes and notary and registry fees are paid to whoever charges them, and we calculate them for you beforehand.
How much inheritance tax (Impuesto de Sucesiones) is paid in Madrid?
Very little if you inherit from your parents, your spouse or partner, or your children: the Comunidad de Madrid (Madrid region) gives a 99% reduction of the tax. For siblings, nephews, nieces, uncles and aunts the reduction is 50% (deaths from 1 July 2025). You have 6 months to file it, which can be extended by another 6 if you ask in time. Heirs who live outside Spain can apply these regional rules too.
There are several of us siblings and one doesn’t want to sell. What can we do?
First, talk: our lawyers explain the options with numbers (all of you sell, one buys the others out, or you sell only your share). If there is no agreement, they guide you through the legal steps, always looking for the quickest and cheapest way out.
Can we sell before the inheritance is finished?
Not completely: to sell, the property has to be in the heirs’ names. But we can start preparing the sale (photos, price, buyers) while the inheritance is being processed, so no time is lost.
What if the property has a mortgage or debts?
They can be paid off with the money from the sale, on the same day at the notary. Before you accept the inheritance, our lawyers review the debts and tell you whether to accept it “a beneficio de inventario” (with the benefit of inventory), so you don’t answer for them with your own money.
Do we all have to travel to Spain?
Not necessarily. Heirs abroad can usually take part through a power of attorney, granted before a notary or at a Spanish consulate. Our lawyers tell you exactly what’s needed.
