Part A. Tenants
1. What Llavely offers tenants
1.1. The tenant creates a profile setting out what they are looking for (areas, budget, type of home, dates, pets, etc.), has it verified and receives invitations from landlords and agencies to view homes that match them.
1.2. Llavely is not a party to the tenancy agreement, which is entered into between the tenant and the landlord (General Terms, section 3).
2. Free use for tenants
2.1. For tenants, Llavely is free, always. There are no subscriptions, paid plans or payments of any kind to Llavely. At no cost, the tenant may:
- create and verify their profile;
- see the published homes and mark "I'm interested" on the ones they like (section 3);
- receive unlimited invitations from landlords and agencies;
- accept or decline each invitation and decide which information they share;
- chat with anti-scam protection;
- arrange viewings using the calendar;
- sign the agreement using the electronic signature tool.
2.2. How it works. The tenant does not write to advertisers or send requests to homes: landlords and agencies see the profiles, ranked solely by the affinity index (document 07), and send invitations. The tenant is free to decide whether to accept each invitation.
2.3. With their free profile, the tenant has full access to the homes they are invited to and may rent any of them without paying Llavely anything.
3. Published homes and "I'm interested"
3.1. Seeing the homes. Anyone can see the homes published in the open provinces (section 16): in a list with filters and a map, and on each home's own page. The exact address is not published: the map shows an approximate area, and only someone who accepts an invitation and confirms a viewing sees the address.
3.2. No writing to the advertiser. From a listing it is not possible to write to the landlord or agency or to request a viewing. The conversation only starts when the advertiser invites the tenant and the tenant accepts the invitation.
3.3. "I'm interested". A tenant with an account can mark "I'm interested" on the homes they like. If they do not have an account, the Platform offers to create their profile. The mark:
- is saved to their profile, under "Flats I'm interested in", and they can remove it whenever they wish;
- does not send any message to the advertiser or commit the tenant to anything;
- does not change the order in which the advertiser sees the candidates, which is always by match with the home;
- is shown to the advertiser, at most, as a discreet tag next to the tenant's profile ("Interested in your flat").
4. Tenant verification and control over information
4.1. What is verified. Identity (DNI/NIE – Spanish national identity document or foreigner's identity number – with a selfie); income (latest payslips or, where applicable, [alternative documentation for self-employed persons, pensioners, students with a guarantor — to be defined]); optionally, employment contract and an introductory video of up to 30 seconds.
4.2. How it is verified. The documents are checked by an artificial intelligence system from an external provider [name to be defined]. If the system cannot confirm a piece of information or something does not add up, the document is not rejected automatically: a member of the Llavely team reviews it. The tenant can ask at any time for a person to review the result, explain their situation and correct their details.
4.3. Who sees what.
| Information | Llavely team | Landlord / agency |
|---|---|---|
| Identity document and selfie | Yes (and the verification provider) | No — only "Identity verified" |
| Payslips and employment contract | Yes (and the verification provider) | No — only "Income verified" and the rent-to-income ratio for their home |
| Introductory video | Yes | Only if the tenant makes it visible |
| Optional documentation ("Strengthen your profile") | Yes, in order to verify it | No — only the corresponding badge (e.g. "Payments up to date", "No recorded debts") |
| Profile data (areas, dates, pets…) | Yes | Whatever the tenant decides to show |
| Homes marked "I'm interested" | Yes | Only the tag "Interested in your flat", on their own home |
4.4. The tenant decides which information is shown before accepting an invitation. No data is requested or shown that is not necessary to assess solvency or suitability for the home.
4.5. Verification expires after [6/12] months or when circumstances change (for example, a new job), and the tenant may update it.
4.6. Llavely does not provide credit reference services and does not consult debtor registers.
4.7. Optional documentation. The tenant may, if they wish, provide documents that strengthen their profile: employment contract, receipts from their previous tenancy, a reference from their previous landlord, a debtor-register report obtained by the tenant themselves, a Social Security employment history report (informe de vida laboral), a savings certificate, a bank guarantee or surety insurance, an income tax return, certificates of being up to date with tax and Social Security obligations, university enrolment or grant, and their pet's health record. Providing them is voluntary, and not providing them does not penalise the profile or the affinity index. Llavely only checks the document (with the same system as in section 4.2) and shows the landlord a badge; it deletes the file after verifying it and keeps the result for as long as the profile is active. The tenant is advised to conceal any data that is not necessary.
5. What Llavely never charges the tenant
- Commissions or fees for renting a home.
- Property management or agreement formalisation costs.
- Use of the agreement and signature tool.
- Any "holding" amount in favour of Llavely.
If a landlord or agency asks the tenant for any of these amounts, or for any payment before the viewing, the tenant may report it using the "Report" button.
Part B. Private landlords
6. Scope
6.1. This part applies to natural persons who list homes for rent as private individuals. Agencies and property professionals are governed by the Terms for Agencies (document 08).
6.2. A private landlord may list as many homes as they have, with no limit.
7. Free use
7.1. Everything free. The landlord can use Llavely free of charge and with every feature: listing their homes, verifying them, seeing candidates, inviting, chatting, arranging viewings and preparing and signing the agreement. Llavely does not ask for a card or bank details.
7.2. Future fees. Llavely may introduce fees for landlords in the future. It will give at least 30 days' notice, by email and in the account, and will never charge anything without the landlord's express acceptance.
7.3. What the tenant does not pay. The tenant pays Llavely nothing, now or later (section 5).
8. Verification of identity and ownership, and review of each home
8.1. In order to list a home, the landlord must verify their identity (DNI/NIE with a selfie) and their ownership of the home by means of a nota simple (land registry extract) from the Registro de la Propiedad (Land Registry) [no more than 3 months old], the purchase deed or the IBI (property tax) receipt in their name.
8.2. If the advertiser is not the owner (for example, a relative or a usufructuary), they must provide documentation evidencing their authority (signed authorisation from the owner, power of attorney, deed of usufruct). Llavely may refuse the listing if this is not evidenced.
8.3. In the case of co-ownership, the advertiser declares that they have the consent of the other co-owners.
8.4. Checked by hand. Before it is published, a member of the Llavely team checks each home, normally within 24 hours: that it belongs to whoever is listing it, that the address exists and that the details and photos are consistent. Until then, the home is not published. If something is missing, Llavely asks the landlord for it; if it is not evidenced, the home is not published.
8.5. Verification of ownership does not mean that Llavely guarantees the absence of charges, restrictions or prohibitions (for example, a prohibition on letting in subsidised housing or under the statutes of the owners' association), which the landlord must check.
9. Listing a home by pasting the text of an advert
9.1. To save time, the landlord can paste the text of one of their own adverts (for example, the one they already have on another website). The Platform extracts the details it can (price, floor area, bedrooms, bathrooms, floor, features, neighbourhood, description…), places them in the listing and shows the landlord which details are missing.
9.2. It is an aid: the landlord reviews and completes the details before sending the home and is responsible for its content. The landlord uploads the photos.
9.3. Llavely does not download adverts from other websites from their link and does not connect to other portals: it only uses the text the landlord pastes. So that all contact goes through the Platform, Llavely removes phone numbers, email addresses and links from the text.
9.4. The landlord may only paste texts they have written or have the right to use.
10. "Fair price" meter and affinity index
10.1. Fair price. The meter compares the proposed rent with the Sistema Estatal de Referencia del Precio del Alquiler de Vivienda (State Residential Rental Price Reference System) and with third-party market data (cited as a source). If the rent is [within the reference range / below a defined threshold], the listing obtains the public "Fair price" badge (document 07).
10.2. The meter is for guidance only. In stressed residential market areas (zonas de mercado residencial tensionado), the landlord is solely responsible for complying with the rent limits under Articles 17.6 and 17.7 of the LAU (Ley de Arrendamientos Urbanos, the Spanish Urban Leases Act). The "Fair price" badge does not certify that the rent complies with those limits.
10.3. Affinity index. An automatic score that ranks tenant profiles according to how well they match the home (area, budget, dates, type of home, pets, rent-to-income ratio, etc.). Marking "I'm interested" does not change the index or the order. The landlord is free to decide whom to invite; the index is merely an aid. The landlord must not use the Platform's tools to exclude people on discriminatory grounds (section 14).
11. Invitations
11.1. There is no monthly limit on invitations, but each home may have a maximum of 15 invitations awaiting a response at any one time. An invitation that is not answered within 3 days expires automatically and frees the slot (the slot is also freed when the tenant accepts or declines it).
11.2. When the tenant accepts an invitation, the parties can talk through the Platform's chat and arrange the viewing.
12. Tenancy agreement and electronic signature
12.1. Template. Llavely offers a template tenancy agreement for a home (permanent residence or seasonal) or for a room, which the landlord may adapt. The template is reviewed periodically to keep it in line with the LAU, but the landlord is responsible for the final agreement and for ensuring that its clauses are lawful. Llavely is not a party to the agreement and does not provide legal advice.
12.2. Prior information. Before signing and before any amount is handed over, the landlord must provide the tenant, through the transaction record, with the information required under Article 31 of Ley 12/2023 (Spanish Law 12/2023 on the Right to Housing) (General Terms, section 10.3).
12.3. Electronic signature. Signing takes place within the Platform through an electronic signature service provider [name to be defined], which generates a [simple / advanced] electronic signature in accordance with Regulation (EU) No 910/2014 (eIDAS), with supporting evidence (verified identity, time stamps, audit trail). Both parties will receive a copy of the signed agreement.
12.4. Clauses that the template does not allow (or about which it gives a warning): charging the tenant property management or formalisation costs (Article 20.1 LAU); a deposit other than one month's rent for a home (Article 36.1 LAU); additional guarantees exceeding two months' rent in the agreements referred to in Article 36.5 LAU; waiver of the mandatory extension; seasonal letting without a genuine seasonal reason; rents exceeding the applicable limits in stressed areas.
13. Deposit, rent and payments
13.1. Llavely does not collect or handle rental payments. The rent, the deposit and any additional guarantees are paid directly between the tenant and the landlord, by transfer to the account stated in the agreement, whose holder must match the verified landlord. Never before the viewing (General Terms, section 9).
13.2. The statutory deposit (fianza) (one month's rent for a residential tenancy; two months for other uses) is paid by the tenant to the landlord on signing (Article 36 LAU).
13.3. The landlord is the party obliged to lodge the deposit with the competent body of the autonomous community in which the home is located, within the time limits and in the manner laid down by regional legislation. Llavely may facilitate the procedure (reminders, links), but does not lodge the deposit on the landlord's behalf.
13.4. Additional guarantees (bank guarantee, additional deposit, insurance) are agreed between the parties, subject to the limits of Article 36.5 LAU.
13.5. Llavely does not advance or guarantee the rent, is not liable for non-payment and does not offer rent default insurance or guarantor alternatives. If it were to offer any payment or third-party service in the future, it will announce it beforehand, with its own terms, and it will always be optional.
14. Landlord's obligations
The landlord undertakes to:
- Lawfulness of the tenancy: comply with the LAU and Ley 12/2023; not enter into seasonal agreements without a genuine reason; respect the minimum term and statutory extensions.
- Stressed areas: check whether the home is located in a declared stressed residential market area and, if so, comply with the rent limits under Articles 17.6 and 17.7 LAU, disclose the rent under the last agreement and the reference index, and comply with the additional obligations if they are a large holder (gran tenedor).
- Non-discrimination: not reject or select tenants on grounds of racial or ethnic origin, nationality, sex, sexual orientation, gender identity, religion, disability, age, family situation, illness or other personal or social circumstances (Ley 15/2022, Spanish Law 15/2022 on Equal Treatment and Non-Discrimination). Objective solvency criteria and legitimate conditions relating to the home (for example, not allowing pets) are permitted.
- Not charge the tenant property management or agreement formalisation costs (Article 20.1 LAU), nor require deposits or guarantees above the statutory limits, nor ask for payments before the viewing.
- Truthful and complete information in the listing and during the pre-contractual stage (General Terms, section 10).
- Energy performance certificate: hold a valid certificate, display its rating label in the listing and provide it to the tenant.
- Habitability: ensure that the home meets habitability requirements and, where applicable, holds a certificate of habitability (cédula de habitabilidad) or equivalent document.
- Deposit: lodge it with the competent regional body.
- Tax obligations: declare rental income. Llavely, as a platform, may be obliged to report information to the tax authorities (for example, DAC7 — Directive (EU) 2021/514 and the legislation transposing it).
- Data protection: use the tenant's data only for the transaction.
15. Issues during the tenancy
15.1. Issue reporting channel. The tenant and the landlord can report breakdowns and issues to each other through the Platform's chat, which keeps a record of the date, and open an issue with Llavely from "Help".
15.2. Llavely does not carry out or manage repairs and is not responsible for the condition of the home. Maintenance and repair obligations lie with the parties in accordance with the LAU (the landlord, the repairs necessary to keep the home in a habitable condition — Article 21.1 LAU; the tenant, minor repairs due to wear and tear from ordinary use — Article 21.4 LAU) and with what is agreed in the agreement.
15.3. In emergencies (gas leaks, electrical hazards, etc.), the tenant must contact the emergency services (112) directly and the landlord by the quickest available means.
Part C. Common provisions
16. Open provinces and waiting list
16.1. Where it is open. Lettings are open in the provinces of Madrid and Barcelona. Llavely will open the rest province by province and will announce it on the Platform.
16.2. In the open provinces, tenants, landlords and agencies can use all the lettings features.
16.3. Elsewhere, anyone can join the waiting list with their email address, their provinces and, if they wish, their areas. Llavely will email them on the day it opens lettings there. They can also create their account now and get everything ready (profile, verification, homes): homes in those provinces are reviewed and published on the day their province opens, and until then the features that depend on it (invitations, messages, viewings) are not available.
17. High-rent tenancies and anti-money laundering
17.1. Where Llavely takes part in a tenancy with a monthly rent of €10,000 or more (or an annual rent of €120,000 or more), it will be an obliged entity under Article 2.1(l) of Ley 10/2010 (Spanish Law 10/2010 on the prevention of money laundering and terrorist financing), and will apply the due diligence measures described in document 06 (section 9), including identification of the beneficial owner and the source of funds.
17.2. Llavely may refuse to take part in a transaction if it is unable to apply these measures.
18. End of the relationship and retention of documents
18.1. The signed agreement and its signature evidence will be available to both parties in their account for [the term of the agreement and X years thereafter]. We recommend downloading a copy.
18.2. For now, Llavely does not ask for ratings at the end of the tenancy.
18.3. For anything not provided for here, the General Terms apply.
